What does a Process Server do?
A legal process server delivers (or serves ) legal documents to a defendant or an individual
involved in a court case. The process server must serve the documents in accordance
with the laws in the area of service. This may mean personally handing the documents
to the defendant or sub-serving to someone in the same household or business.
Once the documents are delivered, the process serving agent must provide proof
that the paperwork was served correctly. This is done through a document called an
Affidavit of Service, also called a Proof of Service, which may or may not be notarized
as needed by the local regulations and filed with the court.

AFFIDAVITS OF SERVICE: This document is used to prove to the client and
or court
that service has been perfected. It will note date, time, place and manner of service.
An affidavit of service is attested before a notary. |

CERTIFICATE OF SERVICE: This document is used as proof of service. It is attested to
by the person making the service. It will note date, time, place and manner of service.
The certificate of service declares under penalty of perjury that the facts are true
and correct.
And Must be signed and dated. |

CHILD CUSTODY/ VISITATION/ SUPPORT: All documents pertaining to family matters
or changes in those matters must be personally served. Proof of service
will be included
and/or filed with the court on request. |

COURT CASES ISSUED AND FILED: We will hand deliver your original documents
to be filed or issued in your cases in both Justice Court or Superior Court.
Conformed copies will be obtained and sent to you immediately. |

COURT DOCUMENTS RETRIEVED:
We will gladly research, obtain copies or pick up your documents for you when ready. |

DIVORCE SUMMONS/ PETITION: Petitions pertaining to family matters is a request
for the court to make a ruling without assignment of blame. This requires personal service. |

GARNISHMENTS/ BANK OR WAGE: Writ will be served on garnishee along with all
required documents and copies of judgment against the debtor. This must be served personally
or conform to the rules for serving a business entity. Upon receipt of the documents
the garnishee will withhold money or property from the debtor to satisfy the judgment. |

INVESTIGATIVE SERVICES: We have up to date resources for locating the most
current address for service of documents on defendants. We also offer more
detailed searches, background investigations, skip tracing and private detective services. |

LEGAL NOTICES SERVED: We will serve any legal letter, document, demand letter
or notice .
This class of papers represent documents which have a requirement for service
per statute,
but are not actually court documents. These usually pertain to a request
for status of collateral,
credit related issues or merely making sure your customer
receives the important documents personally, but do not require personal service. |

LEGAL NOTICES POSTED: Some notices require that it be posted in a
conspicuous place on a person's residence or property. We will document with a
signed statement and photographs on request. |

LEGAL SERVICE OF YOUR DOCUMENTS: Service of all of your documents
will be served by the Rules of Civil Procedure. Service will be done correctly and legally.
Proofs of service included. |

MOBILE NOTARY: We provide legal notarization of your documents at your office
or client location. We will verify the identities of the individuals
prior to notarizing the documents. |

NOTICE OF TRUSTEE'S SALE: This is a legal document, although not filed or issued
with a court but must conform to certain requirements. The trustee is holder of the
mortgage and should the borrower default the trustee is allowed to sell that property
to satisfy the mortgage.
This notice must be posted at the county court house
and on the property in question.
The posting must take place no less than 20 days
prior to the sale of the property. |

ORDER FOR SUPPLEMENTAL PROCEEDINGS: This order is issued after judgment
has been rendered. This requires the judgment debtor to appear before the court
with records of whatever
assets which the debtor has that can be utilized to
satisfy the judgment. Must be served in person. |

ORDER TO SHOW CAUSE: This order requires a person to appear regarding whether
or not certain relief should be granted. If these orders contain contempt clauses
they must be personally served. |

RUSH SERVICE: We offer RUSH SERVICE 7 days a week. This includes "SAME DAY RUSH",
to be completed before the next morning or "IMMEDIATE RUSH SERVICE"
which will be executed within a few hours. |

SKIP TRACING: We have the most up to date research capabilities to locate a defendant
for service. This will include current address, telephone number and email address and age. |
|
SMALL CLAIMS SUMMONS/ COMPLAINT: Small claims are issued from Justice court
and
are for those cases that are $2500.00 or less. The summons is the document that informs
the person being served that a case has been filed and the requirements for responding.
The complaint states the court's jurisdiction and the circumstances of the plaintiff's claim
and demand for relief. These may be sub served at the defendant's normal place of abode. |

SPECIAL DETAINERS: This is the step in the eviction process where a person
is formally
determined by court to be unlawfully occupying property. The summons
of the special detainer
will include date and time of court hearing and where to appear.
This must be served no less than 2 days prior to the appearance date. This may be substitute
service at the defendant's residence
or if no one is there it may be posted with a
copy and a copy mailed the same day by certified mail to the defendant. This form
of service must be no less than 5 days prior to the hearing
and within one day of the issuance of the summons. |

SUBPOENA DUCES TECUM: Requires the production of documents in addition to,
or in lieu of and appearance. Subpoenas must be served personally on an individual
or may be directed to "Custodian of Records". |

SUBPOENAS TO APPEAR: A subpoena for appearance before a court is issued
with the clerk of court in the county where the appearance is to take place.
A subpoena for a deposition may be issued in the county where the case originated or
where it is to take place. Requires personal service. |

SUMMONS AND COMPLAINTS: Summons informs the defendant in a newly instituted case.
Summons is always served with a complaint. A complaint ( civil ) is the initial phase of a
civil proceeding. This states the basis for the court's jurisdiction, the circumstances
of the plaintiff's claim and a demand for relief. This may be personally served or sub served
at defendant's place of residence. It Must be served within 120 days of the initial filing. |

TEMPORARY RESTRAINING ORDER: This is an order which restrains someone
temporarily from an act. Requires personal service. |
